Care Training East Midlands Ltd. is registered in England and Wales (Registered number 4307537). Care Training East Midlands Ltd also trades as Central Skills and Clinton Training East Midlands.

Care Training East Midlands Ltd. owns this website. “We” and “Us” means Care Training East Midlands, the Care Training East Midlands (CTEM) trademark and brand. It also includes the trademark and brands of Central Skills and Clinton Training East Midlands.

“You” means the user of this website. By using the website you agree to be bound by these terms.

If any of these Terms become void or otherwise unenforceable in whole or in part, the validity of the remainder of these Terms shall not be affected.

If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right, and shall not prevent us from exercising that right in the future.

The blogs provided by CTEM enables staff, learners and stakeholders to post articles and comments. For the purpose of definition, all articles and comments are subject to the terms of this paragraph alongside the rest of the terms and conditions.

The blogs are provided free of charge. Therefore we do not make a guarantee of the availability, performance or continued provision of these services. We reserve the right to modify or to terminate the provision at any time.

Availability of the service may be interrupted from time to time for maintenance purposes. We also reserve the right to establish general rules and limits concerning use of the services from time to time.
You agree that we have no responsibility or liability for the deletion or failure to store any messages or other communications that you send or receive through the blogs.

You acknowledge you are solely responsible for any content or other materials that you send or post to the blogs. Communications sent may be moderated by CTEM and the right is reserved by CTEM to remove any message which is inconsistent with the aim of the blog.

By posting a form of communication on the blog you warrant that your communication complies with the terms and conditions, and/or relevant laws and regulations in force and agree to indemnify CTEM against all legal fees, damages and other expenses that may be incurred by CTEM as a breach of warranty. 

If you discover any material or behaviour of other users which you think is unacceptable or in breach of these terms and conditions you should report it to CTEM, it will be dealt with at the discretion of CTEM.

If you post any comments or content on the blog, you grant CTEM a non exclusive royalty free irrevocable right and licence to reproduce, modify or publish in all media known or in future created throughout the world and authorise others to do so. You further agree to irrevocably and unconditionally waive all moral rights which you may have in respect of any material posted by yourself on the blog.

Terms & Conditions of Booking a Course

Please read these Terms and Conditions (or 'Terms') carefully before booking a course.

These terms and conditions ('Terms') apply to your learning when you enrol onto training with Care Training East Midlands, Central Skills or Clinton Training East Midlands.

For the purposes of these Terms:

  • 'course' means this course that you are signing up to learn.
  • 'enrol' means the process of enrolling for a course.
  • 'learning centre' means the centre where you are enrolled. You may be actually doing your learning in an 'outreach location' that is connected to your learning centre.
  • 'tutor' the person who provides you subject support for your course
  • 'we' and 'us' means Care Training East Midlands, Central Skills or Clinton Training East Midlands.
  • 'you' means the learner.

Quality of the services

We will use reasonable skill and care in providing the services to you. We do not make any commitment to you that the content of the services will meet any specific requirements that you have except to the extent that your requirements match the course description, which is given in more detail on the Website.

We do not make any commitment to you that you will obtain any particular result from your receipt of the services. We do not make any commitment to you that you will obtain any particular qualification from your receipt of the services (unless stated otherwise in the course description on the Website subject to your successful achievement of that qualification).

All representations, warranties and/or terms and/or commitments not expressly set out in these Terms and (whether implied by law, conduct, and statute or otherwise) are hereby excluded to the maximum extent permissible at law.

Payment

You agree to pay us the course fee. Your place on the course will only be reserved after we receive the full payment for the course.

The receipt of the services is personal to you. Only you can consent to transferring your rights to access the course materials.

Your right to use the course and your related obligations:

On payment of the course fee, we grant to you a licence for you to use the course for your own use only. This is for the sole purpose of non-commercial use by you, you can only use the course while you are learning. You may not change, copy, reproduce, re-publish, upload, post, transmit or distribute in any way any part of the course. Any use of the course not permitted in these Terms is strictly prohibited. Such use will constitute an infringement of either our copyright or our other intellectual property rights, or the copyright or other intellectual property rights of people who write courses for us.

Your right to cancel the course:

If you wish to cancel your enrolment, you may do so provided that you tell us a minimum of 7 days prior to the course start date. If you are entitled to a refund of any course fee, this will be paid to you within 30 days of the date of your cancellation. You agree that you will lose your above right to cancel the course and get a refund of any course fee you have paid if you have started using the course. This will not affect your statutory rights. We reserve the right to stop providing the services to you immediately if:

  • you do not follow the way in which you are allowed to use the course;
  • or you act in such a way as to threaten, intimidate or otherwise harass our staff or other learners.

If we exercise this right your learning centre will tell you by email or by your chosen route. We will then immediately withdraw your access to the course.

Refund Policy

If you cancel your course start date and rebook onto the same course at a later scheduled date, there is no additional payment required.

If you cancel your course a minimum of 7 days before your course start date, you will lose 50% of the course fees.

Our liability to you

We will not be liable if we cannot provide the services to you because of an event beyond our reasonable control. Such events include (but are not limited to) events such as fire, flood, storm, strikes or other industrial action, failure of telecommunications services, war, riot, or the actions of any government or public body, failure or insolvency of the training provider. If we are prevented from providing the services by such an event, we will take all reasonable steps to try to reinstate the provision of the services to you as soon as is reasonably practicable. In no event will we be liable for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer.

In no event will we be liable to you for any indirect or consequential loss that you may suffer. If the course in online, we are not liable for any data that you lose either as a result of accessing the course or during completion of any course. It is your responsibility to ensure that you regularly save and back up all data which you hold on the computer from which you are accessing the course, and all data that you are inputting when completing the course.

Except where the above applies, our maximum aggregate liability for any claim that you may have against us in connection with the provision by us to you of the services, which is not otherwise excluded in these Terms, (including without limitation where such claim arises as a direct result of any negligent technical advice provided by us), will be limited to the amount of the course fee which has been paid or is payable by you or on your behalf.

The exclusions and limitations of liability contained in these Terms and the terms and conditions do not apply to any loss or damage resulting from death or personal injury caused by our negligence, loss or damages arising from our fraudulent misrepresentation, or any other losses which may not be excluded or limited by law.

Liability

 We shall not be liable to you for any of the following types of loss or damage arising out of or in connection with your use of the Website or any or content and/or facilities provided via the Website:

  • any loss of profits, loss of earnings, loss of anticipated savings, goodwill or revenue;

  • any indirect or consequential loss.

The exclusions and limitations of liability contained in this section do not apply to:

Amendments to the Terms

We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded on to this Website. The date of the last revision to these Terms is provided at the end of the Terms. We recommend that you visit this page each time you visit the Website to ensure that you are aware of and are complying with any changes that we have made to these Terms. If you continue to use the Website you will be deemed to have accepted those changes from the point at which these changes come into effect.

General Subject to the terms of any agreement we conclude with you if you enrol on a course with us, these Terms are governed by and will be understood in accordance with English law. The contract between us is concluded in the English language. Any dispute arising between us under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English courts.

These Terms constitute the entire agreement between us in relation to the provision by us to you of the Services, and they replace and supersede any prior arrangements between us in relation to the Services.

You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Services other than those expressly set out in these Terms. Nothing in this Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation.

The agreement between us which is comprised of these Terms is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

The continued use of the Website following any changes to the Terms will mean that you accept such changes.

Health, Safety & Environmental Policy

Statement

Care Training East Midlands (CTEM) and Central Skills work to bring practical support to improving the general and specific skills relating to various occupational areas throughout the region, along with using world-class, innovative, high-performance teaching in partnership with businesses and the wider community.

Alongside this, CTEM and Central Skills believe protection of the environment is an integral part of good institutional practice and that it has a duty to satisfy itself that all of its operations are conducted with proper regard for the environment, with commitment to maintaining (and wherever possible) improving the quality of the environment for both the people employed by us, those who utilise our facilities and for the wider community now and in the future.

We consider that the health, safety and welfare of all employees and of all other persons affected by our operations are of the utmost importance. Learners are a particularly vulnerable group and operations are accordingly conducted in the specific context of learners being entitled to a safe, healthy and supportive environment.
CTEM and Central Skills seek to make the most effective and efficient use of all resources, encouraging all employees and learners to develop an ecologically sound approach to their work. As part of this commitment and high standards of governance, we place Occupational Health and Safety and Environmental considerations at the heart of our activities. To ensure continual improvement, we maintain an ongoing Improvement Plan and are working towards achieving OHSAS 18001 and EMS 14001.

Aims

In particular, CTEM and Central Skills will:

  • Meet all relevant legislation, government guidelines, regulations and industry codes of practice on health and safety and environmental issues (and, where possible, exceed them).
  • Ensure that, on a continual basis, HSE hazards and aspects are identified, risk assessed and suitable controls put in place to prevent injury and ill health.
  • Develop management processes to ensure that Occupational Health, Safety and Environmental factors are considered during planning and implementation of learning.
  • Engage with employees, contractors and visitors to further reduce Occupational Health, Safety and Environmental hazards and risks associated with working for, with or on behalf of CTEM and Central Skills.
  • Ensure that working safely is a condition of employment and engagement.
  • Reduce consumption and costs whilst satisfying the need for energy and water.
  • Reduce the environmental impact of CTEM and Central Skills through better management of their material resources.
  • Integrate environmental and sustainable principles into CTEM and Central Skills’ operational procedures and promote best practice at every opportunity.
  • Maintain a commitment to train all staff in Health, Safety and Environmental awareness to support learning.
  • Pursue continual improvement in Health, Safety and Environmental performance.
  • Comply with any other relevant requirements to which we subscribe (for example, contractual requirements).

Responsibility

All employees have a responsibility to contribute to CTEM and Central Skills’ policy of minimising any adverse health, safety and environmental impact. Operational responsibility lies with the Managing Director and Senior Management with direction from the Facilities Manager. The HSE policy will be reviewed by Senior Management and the Facilities Manager at least annually.

Safeguarding Vulnerable Persons Policy

Statement

Care Training East Midlands make every effort to comply with safeguarding legislation and guidance issued by CRB, ISA and the Department of Education.

Care Training East Midlands maintains a Single Central Record of safeguarding checks on our staff involved in Regulated Activity Programmes (RAPs) and CRB checks on all employees and any relevant contractors.

If you have any safeguarding issues please contact one of the safeguarding designates, their names and pictures can be found on the walls in the stairwells. You can also contact reception and they will find a safeguarding designate for you.

Guidance

Responsibility

This policy is the responsibility of all employees who have contact with vulnerable persons.

The Single Central Record is maintained by the Designated Safeguarding Officer.

This policy will be reviewed as further guidance and legislation becomes available.
